If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with the privacy policy govern James Bennett’s relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use the website.

Terms

By accessing the website at https://james-bennett.com, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

Use Licence

  1. Permission is granted to temporarily download one copy of the materials (information or software) on James Bennett’s website for personal, non-commercial transitory viewing only.
  2. This licence shall automatically terminate if you violate any of these restrictions and may be terminated by James Bennett at any time. Upon terminating your viewing of these materials or upon the termination of this licence, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Disclaimer

  1. Once the developed site has been signed off, it is the responsibility of the client to handle the transfer of the site to their hosting. The site will be packaged up and sent over to the client. Alternative agreements/arrangements can be made, however this needs to be done prior to any development work has started.
  2. After the delivery of a fully functioning website, the sole responsibility of the site, (backups, security, updates of plugins, updates of the core WordPress and WordPress theme) going forward is that of the client. James Bennett will be happy to help with troubleshooting and will offer to fix issues if something goes wrong in future, at reasonably short notice, for an extra charge.
  3. Alternatively, there are companies James Bennett can point you in the direction of, if, issues do occur. These are reputable 3rd party companies, with UK based support.
  4. From time to time, updates to themes may be needed to allow core functionality of the site to continue, (This could be due to changes in web browser updates etc, or to patch security issues within the theme itself). If the theme cannot be updated through the admin dashboard of WordPress, James Bennett can supply the latest version of the theme available.
  5. It is the responsibility of the client;
    1. To ensure that there theme is up to date – If the client is unsure of the theme in use, or isn’t sure if the theme is out of date, James Bennett can advise.
    2. To update the theme via the admin side of the site, or, with the latest supplied version, following the advice/instructions of the theme developer.
    3. To fix/resolve any issues that occur after the theme update themselves. James Bennett will be happy to help with troubleshooting and will offer to fix issues if something goes wrong in future, at reasonably short notice, for an extra charge.

Limitations

In no event shall James Bennett or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on James Bennett’s website, even if James Bennett or a James Bennett authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Accuracy of materials

The materials appearing on James Bennett’s website could include technical, typographical, or photographic errors. James Bennett does not warrant that any of the materials on its website are accurate, complete or current. James Bennett may make changes to the materials contained on its website at any time without notice. However James Bennett does not make any commitment to update the materials.

James Bennett has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by James Bennett of the site. Use of any such linked website is at the user’s own risk.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of UK and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
